Kevin A. Seely
PARTNER
Kevin A. Seely devotes his practice to representing shareholders, consumers, and employees in complex class, derivative, and qui tam actions throughout the United States. A tenacious trial lawyer with more than fifteen years of litigation experience in both the public and private sectors, Mr. Seely has successfully prosecuted top corporate executives, high-ranking government officials, and corporate entities for a variety of fraud schemes from theft of government services, bribery and embezzlement to health care fraud.
Prior to joining Robbins Umeda LLP in 2006, Mr. Seely prosecuted white-collar crimes and public corruption cases as an Assistant United States Attorney for the Districts of Guam and Northern Mariana Islands. He also investigated and prosecuted civil fraud cases for the U.S. Attorney's Office for the Southern District of California. Before becoming a federal prosecutor, Mr. Seely was a partner at a prominent commercial litigation law firm in Guam.
Mr. Seely earned his Juris Doctor degree in 1992 from the Northwestern School of Law of Lewis & Clark College, where he served as associate editor of the Lewis & Clark Law Review. He graduated cum laude from the University of California, Irvine in 1988 and was team captain of UCI's nationally ranked men's water polo team.
Selected Noteworthy Cases
- Wireless Facilities, Inc. (now known as Kratos Defense & Security Solutions, Inc.), In re Wireless Facilities, Inc. Derivative Litigation, No. 04-CV-1663-JAH-(NLS) (S.D. Cal. Mar. 29, 2010): The firm, as co-lead counsel, represented Wireless Facilities, Inc. derivatively on behalf of shareholders in the shareholder derivative action alleging company insiders "backdated" and "springloaded" employee stock option grants at less than fair market value, and that the options were granted using insider knowledge of a significant increase in the company's stock price. Working closely with firm partner Brian Robbins, Mr. Seely played a key role in the hard-fought litigation, during which he engaged in extensive motion practice, document discovery, and appellate work. Mr. Seely helped achieve a settlement that required certain officers to forfeit significant amounts of stock and stock options back to the company, restricted voting rights for certain former officers and directors, secured monetary reimbursement to the company, and implemented a number of important changes to Kratos' corporate governance.
- Derivative Recoveries for the U.S. Government: In actions filed on behalf of various U.S. federal agencies, Mr. Seely played a lead role in the investigation, litigation, and negotiations of numerous settlements resulting in the return of millions of dollars to the victims of complex accounting and contract fraud schemes.
- Public Corruption and White Collar Crime Verdicts: On behalf of the U.S. government, Mr. Seely successfully led teams to investigate, prosecute, and negotiate the resolution of numerous complex financial fraud cases, resulting in the restoration of public trust and the return of funds to various victim entities and individuals.
